Language-of-thought hypothesis (LoTH) is having a profound impact on cognition studies. However, much remains unknown about its basic primitives and generative operations. Infant studies are fundamental, but methodologically very challenging. By distilling potential primitives from work in natural-language semantics, an approach beyond the corset of standard formal logic may be undertaken. Still, the road ahead is challenging and long.

Whether copyrights should exist in content generated by an artificial intelligence is a frequently discussed issue in the legal literature. Most of the discussion focuses on economic rights, whereas the relationship of artificial intelligence and moral rights remains relatively obscure. However, as moral rights traditionally aim at protecting the author’s “personal sphere”, the question whether the law should recognize such protection in the content produced by machines is pressing; this is especially true considering that artificial intelligence is continuously further developed (...) and increasingly hard to comprehend for human beings. This paper first provides the background on the protection of moral rights under existing international, U.S. and European copyright laws. On this basis, the paper then proceeds to highlight special issues in connection with moral rights and content produced by artificial intelligence, in particular whether an artificial intelligence itself, the creator or users of an artificial intelligence should be considered as owners of moral rights. Finally, the present research discusses possible future solutions, in particular alternative forms of attribution rights or the introduction of related rights. (shrink)

Resumen: El texto propone un recorrido sucinto por los modos en que las lecturas marxistas de fines de los años setenta del siglo XX se apropiaron de la figura de Carl Schmitt, con el propósito de enriquecer con su concepción fuerte de lo político lo que era considerado una debilidad propia del marxismo: su teoría política. Se toman dos casos paradigmáticos en materia de articulación entre Schmitt y Marx: el del italiano Mario Tronti y el del argentino José María Aricó. (...) La lectura parte de la hipótesis de que los ejercicios de Tronti y Aricó se pueden leer como intentos de complementar a Marx con las contribuciones de Schmitt, razón por la cual permanecen al interior del marxismo como horizonte problemático. Finalmente, sugerimos que sobre todo a partir de los años ochenta, y con mayor énfasis de los noventa hacia el presente, las lecturas de Schmitt que continuaron formulándose desde el campo de las izquierdas se hicieron por fuera -y quizá en contra- del marxismo, en la medida en que se lo considera incapaz de producir una teoría compleja de lo político. Se abre entonces la pregunta por los alcances de estas distintas operaciones en materia de crítica del presente.: This paper proposes a brief tour of the ways in which Marxist readings of the late 1970s appropriated the figure of Carl Schmitt in order to enrich Marxist political theory with Schmitt’s strong conception of the political. The paper revisits two paradigmatic cases of complementarity between Schmitt and Marx: the Italian Mario Tronti and Argentine Jose Maria Aricó. The paper puts forward the hypothesis that the exercises of Tronti and Aricó are attempts to supplement Marx with contributions from Schmitt, which is why they remain problematic within Marxism. Finally, we suggest that from the 1980s onward, and with greater emphasis since the 1990s, readings of Schmitt made from the left are outside Marxism, to the extent that they are considered unable to produce a complex theory of the political. Background The American Association of Medical Colleges has called for incorporation of the health humanities into medical education, and many medical schools now offer formal programs or content in this field. However, there is growing recognition among educators that we must expand beyond empathy and wellness and apply the health humanities to questions of social justice – that is, critical health humanities. In this paper we demonstrate how this burgeoning field offers us tools for integrating social justice into medical education, (...) utilizing the frameworks of critical consciousness and structural competency. Practice of health humanities Critical health humanities can be applied at multiple levels of learners, and in a variety of contexts. We are two physician-writers who have developed several educational programs that demonstrate this. We taught a seminar that introduced first-year and second-year undergraduates to concepts such as social determinants of health, intergenerational trauma, intersectionality, resilience, and cross-cultural care through works of fiction, poetry, film, podcasts, stand-up comedy, and more. Through creative projects and empathic reflection, students engaged with the complexities of structural forces that create and maintain health disparities. Medical students in their clinical years can engage in critical health humanities learning experiences as well. We teach several multidisciplinary electives that address social (in)justice in medicine, as well as mentor fourth-year students engaged in independent electives that foster critical awareness around health equity and ethics. Beyond the classroom, we have actively engaged in critical health humanities practices through story slams, literary journal clubs, conference presentations, and Grand Rounds. Through these activities we have included learners at GME and CME levels. These examples also demonstrate how community engagement and multidisciplinary partnerships can contribute to the practice of critical health humanities. Conclusion In this paper, we explore the growing field of critical health humanities and its potential for teaching health equity through narrative practices. We provide concrete examples of educational activities that incorporate critical consciousness and structural competency – frameworks we have found useful for conceptualizing critical health humanities as a pedagogical practice. We also discuss the strengths and challenges of this work and suggest future directions. (shrink)

The article focuses on the Gramscian concept of national-popular will based on its productivity to account, especially, for two central aspects of the constitution of political subjects: the need to enroll in a history, understood as articulation of different moments of resistance and political struggle; and the centrality of a "Jacobin" moment that produces political unity and, in this way, contributes to the construction of that history. O texto tematiza em que sentido a experiência de Alfabetização filosófica se inspira e ao mesmo tempo se diferencia do curso de Alfabetização oferecido por Paulo Freire em (...) Angicos em 1963. Inspirado na curiosidade e no compromisso de Paulo Freire com os esfarrapados do mundo, o conceito “alfabetização filosófica” propõe uma formação experiencial sustentada nas seguintes disposições: escutar atentamente o mundo humano e não humano que nos rodeia; pensar juntos com cuidado e calma; relacionarmo-nos cooperativa e não competitivamente com as ideias das outras pessoas; perguntarmo-nos, colocando em questão, nossa vida e a maneira como nos relacionamos com ela, num tempo especial, singular, suspendido; conversar como iguais na busca de enfrentar as exigências de nossa comunidade; inventar novas formas de estar com outras e outros. Studies on age-related differences in risk perception in a real-world situation, such as the recent COVID-19 outbreak, showed that the risk perception of getting COVID-19 tends to decrease as age increases. This finding raised the question on what factors could explain risk perception in older adults. The present study examined age-related differences in risk perception in the early stages of COVID-19 lockdown, analyzing variables that can explain the differences in perception of risk at different ages. A total of 1,765 adults (...) aged between 18 and 87 years old completed an online survey assessing perceived risk severity and risk vulnerability of getting COVID-19, sociodemographic status, emotional state, experience relating to COVID-19, and physical health status. Results showed that the older the participants, the lower the perceived vulnerability to getting COVID-19, but the higher the perceived severity. Different predictors explain the perception of risk severity and vulnerability at different ages. Overall, self-reported anxiety over the pandemic is a crucial predictor in explaining risk perceptions in all age groups. Theoretical and practical implications of the empirical findings are discussed. (shrink)

BackgroundEverybody has the right to decide whether to receive specific medical treatment or not and to provide their free, prior and informed consent to do so. As dementia progresses, people with Alzheimer’s dementia (PwAD) can lose their capacity to provide informed consent to complex medical treatment. When the capacity to consent is lost, the autonomy of the affected person can only be guaranteed when an interpretable and valid advance directive exists. Advance directives are not yet common in Germany, and their (...) validity is often questionable. Once the dementia diagnosis has been made, it is assumed to be too late to write an advance directive. One approach used to support the completion of advance directives is ‘Respecting Choices’®—an internationally recognised, evidence-based model of Advance Care Planning (ACP), which, until now, has not been evaluated for the target group of PwAD. This study’s aims include (a) to investigate the proportion of valid advance directives in a memory clinic population of persons with suspected AD, (b) to determine the predictors of valid advance directives, and (c) to examine whether the offer of ACP can increase the proportion of valid advance directives in PwAD.MethodWe intend to recruit at leastN = 250 participants from two memory clinics in 50 consecutive weeks. Of these, the first 25 weeks constitute the baseline phase (no offer of ACP), the following 25 weeks constitute the intervention phase (offer of ACP). The existence and validity of an advance directive will be assessed twice (before and after the memory clinic appointment). Moreover, potential predictors of valid advance directives are assessed.DiscussionThe results of this study will enhance the development of consent procedures for advance directives of PwAD based on the ACP/Respecting Choices (R) approach. BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

BackgroundThe UN Convention on the Rights of Persons with Disabilities, and the reformed guardianship law in Germany, require that persons with a disability, including people with dementia in Alzheimer’s disease (PwAD), are supported in making self-determined decisions. This support is achieved through communication. While content-related communication is a deficit of PwAD, relational aspects of communication are a resource. Research in supported decision-making (SDM) has investigated the effectiveness of different content-related support strategies for PwAD but has only succeeded in improving understanding, (...) which, although one criterion of capacity to consent, is not sufficient to ensure overall capacity to consent. The aim of the ‘spatial intervention study’ of the DECIDE project is to examine an innovative resource-oriented SDM approach that focuses on relational aspects. We hypothesise that talking to PwAD in their familiar home setting (as opposed to a clinical setting) will reduce the complexity of the decision-making process and enhance overall capacity to consent. MethodsPeople with a suspected or confirmed diagnosis of dementia in Alzheimer’s disease will be recruited from two memory clinics (N = 80). We will use a randomised crossover design to investigate the intervention effect of the decision-making place on capacity to consent. Besides reasoning capacity, which is part of overall capacity to consent and will be the primary outcome, various secondary outcomes (e.g., other aspects of capacity to consent, subjective task complexity, decisional conflict) and suspected moderating or mediating variables (e.g., meaning of home, demographic characteristics) will be assessed.DiscussionThe results of the study will be used to develop a new SDM strategy that is based on relational resources for PwAD. If a change in location achieves the anticipated improvement in capacity to consent, future research should focus on implementing this SDM strategy in a cost-effective manner in clinical practice.Trial registration: DRKS00030799. The received view of Martin Heidegger’s work is that he leaves little room for reason in the practice of philosophy or the conduct of life. Citing his much-scorned remark that reason is the “stiff-necked adversary of thought”, critics argue that Heidegger’s philosophy effectively severs the tie between reason and normativity, leaving anyone who adheres to his position without recourse to justifying reasons for their beliefs and actions. Transcending Reason is a collection of essays by leading Heidegger scholars that challenges this (...) view by exploring new ways to understand Heidegger’s approach to the relationship between reason, normativity, and the philosophical methodology that gives us access to these issues. Se trata de captar la evolución del concepto de hombre y de tecnología desde la perspectiva de Martín Heidegger, desde los parámetros presentados en la pregunta por el ser y la pregunta por la técnica a lo largo de su obra. Se revisan las nuevas concepciones sobre el mundo y se plantea una visión crítica sobre la relación sujetoobjeto; para ello se intenta clarificar los conceptos de Dasein y Gestell, como puntos vitales desde donde se puede emprender dicha indagación. .

In Eckhart, Heidegger, and the Imperative of Releasement, Ian Alexander Moore investigates Martin Heidegger’s use of releasement. Moore argues that this conceptual development was greatly influenced by Meister Eckhart’s thought. In addition to their shared use of releasement, Moore suggests, both Heidegger and Eckhart share similar philosophical strategies. The task of Moore’s monograph is to illuminate how releasement functions in Heidegger’s work and to argue that Eckhart was one of Heidegger’s central influences. This paper offers some brief reflections on pragmatist themes in Georg Simmel’s philosophy. §1 presents a number of assessments – by Simmel’s contemporaries, by later interpreters, and by Simmel himself – concerning his proximity to pragmatism. §2 offers a reconstruction of Simmel’s 1885-paper “The Relationship between the Theory of Selection and Epistemology,” focusing in particular on what the argument owed to von Helmholtz. It was this paper first and foremost that suggested to many that Simmel was close to pragmatism. §§3-5 (...) follow the development of the core idea of the 1885-paper in Simmel’s subsequent writings. §§6-8 compare and contrasts Simmel’s views on evolution and truth with the positions of Peirce, James, and Dewey. §9 returns to the overall question whether Simmel was a pragmatist and offers an irenic answer. En los últimos años de la Edad Moderna y ya a lo largo de toda la Contemporánea, la celebración de la Semana Santa de Sevilla se convierte en la gran fiesta religiosa de la urbe hispalense. En el siglo XIX el establecimiento de la corte de los Montpensier a orillas del Guadalquivir convierte bajo la égida de los duques tanto a la ciudad como a su fiesta pasional en acontecimientos turísticos de amplitud genuinamente europea e internacional. En el encuadre de (...) este contexto histórico, hay que estudiar la visita del restaurado rey Alfonso XII en 1877, donde principia el legendario romance con su prima María de las Mercedes. Se hace muy presente en las vivencias de la ciudad, queda asombrado por la grandeza litúrgica del Triduo Sacro de la Santa Iglesia Catedral concediendo a su cabildo el título de Excelentísimo y preside el paso del Duelo de la cofradía del Santo Entierro, primera vez en la historia que un descendiente del Trono de san Fernando lo realiza en el cortejo procesional de una cofradía sevillana. Durante la estancia de la corte de Felipe V en Sevilla entre los años de 1729 a 1733, la ciudad agonizante tanto social como económicamente tras perder la hegemonía universal que le hizo ser Puerta de las Américas, vive un período de esplendor que le hace soñar por ese tiempo con las glorias de tiempos pasados. La estancia de la corte exalta el sentimiento religioso del pueblo fiel, se sigue luchando por la definición dogmática de la Inmaculada Concepción, los reyes (...) participan en ceremonias litúrgicas catedralicias y es el propio Felipe V el que consigue la finalización de la urna barroca de Laureano de Pina para venerar el cuerpo incorrupto de Fernando III beatificado en 1671 y cuyo estreno tuvo lugar el 14 de mayo de 1729 en una ceremonia claramente barroquizante y definida por un cronista contemporáneo como “la función mas prodigiosa que ha habido en los siglos”. En este trabajo trato de demostrar que Nino no logra articular un liberalismo completamente antiperfeccionista en su respuesta al comunitarismo. Para ello, parto de reconstruir el diagnóstico que Nino ofrece de la crítica comunitarista al liberalismo y señalo que para darle respuesta se compromete con una concepción particular del bien basada en la idea de autorrealización autónoma. En la siguiente sección desarrollo la manera en la que esa concepción del bien da forma al liberalismo de Nino y, en el apartado (...) siguiente, la confronto con un experimento mental destinado a evaluar si es capaz de bloquear distintas políticas estatales de corte perfeccionista. En la última sección ofrezco unas breves conclusiones respecto al modo en el que la adopción de una concepción del bien particular limita las pretensiones antiperfeccionistas de su teoría liberal. In this paper I attempt to prove that Nino does not succeed in developing a fully antiperfectionist account of liberalism as an answer to the communitarian challenge. I begin with a reconstruction of Nino’s diagnosis of the communitarian challenge to liberalism and point out that, in order to answer it he commits himself to a particular conception of the good based on the idea of autonomous self-realization. In the next section I develop the way by which that conception of the good shapes Nino’s liberalism. I further challenge his liberalism with a mental experiment designed to asses if it is capable of blocking several perfectionist State policies. In the last section I offer some brief remarks on the way the adoption of a particular conception of the good limits the antiperfectionist scope of Nino’s liberalism. (shrink)

In this book, leading scholars draw on the latest research to explore what birdsong can tell us about the biology of human speech and language and the consequences for evolutionary biology. They examine the cognitive and neural similarities between birdsong learning and speech and language acquisition, considering vocal imitation, auditory learning, an early vocalization phase, the structural properties of birdsong and human language, and the striking (...) similarities between the neural organization of learning and vocal production in birdsong and human speech. After outlining the basic issues involved in the study of both language and evolution, the contributors compare birdsong and language in terms of acquisition, recursion, and core structural properties, and then examine the neurobiology of song and speech, genomic factors, and the emergence and evolution of language. En este artículo se propone una interpretación no paradójica de la defensa que hiciera Hobbes del realismo científico de corte materialista. Se trata de explicar cómo este autor pudo defender la verdad del materialismo y, a la vez, negar que ello pudiera ser demostrado metafísicamente. La clave de su posición depende del uso metafórico del concepto de 'imitación' y del tratamiento del poder infinito e irresistible de dios como su atributo filosóficamente relevante. Así, la intención de Hobbes consistiría en decir (...) que la explicación, que no demostración, de la verdad del materialismo depende de la paridad y continuidad ontológica entre el mundo y el ser humano, tal y como éstas son explicadas por la ciencia empírica. En este sentido el proyecto de Hobbes, bien distinto al de Descartes, sería un intento de naturalizar la epistemología que, no obstante, es consciente de los límites metafísicos que afectan a las propuestas naturalizadoras de la filosofía.
